History of the Penske/Zenith Accident Debris and TCEQ Response


TDSL  DISPUTE OVER THE PENSKE/ZENITH ACCIDENT DEBRIS

The dispute between TDSL, Penske, Zenith, and the TCEQ over the Penske/Zenith Accident Debris has been resolved to the satisfaction of all parties as of December 20, 2007.  This portion of the website offers a brief summary of the dispute and its resolution through documents found in the public record.  TDSL’s disagreement with EPA over the May 16, 2006 EPA Determination Letter is not yet resolved.   TDSL has requested the EPA to withdraw or appropriately revise or supplement its Determination and will continue to challenge the EPA Determination Letter in federal court until then.  The following documents are attached for the reader’s reference:

  • One of the Hazardous Waste Manifests that directed shipment, treatment and disposal of the contents of each and every one of the 99 rolloff containers of waste, which contained the Penske/Zenith television tubes (CRTs) deposited at the TDSL landfill working face on October 9, 1997.  Note:  A portion of the load in some of the 99 rolloff containers was transferred to other rolloff containers, to reduce the weight for legal load shipments.  Consequently, there was a total of 104 rolloff containers hauled to the hazardous waste landfill for treatment and disposal.
